Belgica Files Disbarment Raps Against Ombudsman Morales for Clearing Pres. Aquino in DAP Case

Former senatorial candidate and Manila City councilor Greco Belgica filed a disbarment raps against Ombudsman Concita Carpio Morales for clearing former President Noynoy Aquino over the controversial DAP case.

Greco Belgica asked the Supreme Court (SC) of the Philippines on Friday to strip Ombudsman Morales of her license as a lawyer for clearing former Pres. Aquino over his administration's implementation of the controversial Disbursement Acceleration Program (DAP).

According to Belgica's petition he urged the high tribunal to disbar Morales, saying the retired Supreme Court Justice violated the Lawyer's Oath and the Canon of Professional Responsibility when he approved earlier this month the resolution absolving Aquino of the charges for technical malversation, usurpation of legislative powers, and graft.

Belgica was quoted as saying on his complaint "In absolving the (former president of criminal liability by omitting his name in the discussion relative to the finding of probable cause against former (Budget) Secretary Florencio Abad, the Filipino people was deprived of their right to procedural due process," the complaint stated.

The complaint added further that "Hence, the Ombudsman violated her lawyer's oath when she deprived of their right to procedural due process, a right enshrined in our Constitution and mandated by law," it added.

Ombudsman Morales is accused of violating Rule 6.01 of the Canon of Professional Responsibility when she allegedly failed to perform her duty "to see that justice is done."

The complaint also alleged that Morales violated Canon 7 and Rule 7.03 of the same code on the ground that she failed to "uphold the integrity and dignity" of the legal profession in clearing Aquino of the charge of usurpation of legislative powers "without reason." "Taking into consideration the fact that the former president appointed her, her conduct of favoring the former president adversely reflected her fitness to practice law," it said.

Pres. Noynoy Aquino appointed Ombudsman Conchita Carpio-Morales to head the anti-graft body following her retirement from the Supreme Court in 2011.

Tesla cloud account hacked to mine cryptocurrency
