BIR Files Tax Evasion Case Worth P39.6 Million Against Actor Richard Gutierrez

The administration of Pres. Rody Duterte continue its drive against alleged tax evaders as the Bureau of Internal Revenue files tax evasion case worth around P39.60 million against popular TV actor Richard Gutierrez and his production company.


According to BIR they filed the criminal complaint against Richard Gutierrez on Friday before the Department of Justice (DOJ).

BIR stated that Richard Gutierrez, the President of R Gutz Production Corp., attempted to evade paying taxes and failed to file income tax returns in 2012. These are in violation of several sections of the Internal Revenue Code of 1997, or the Tax Code, the bureau sai.

According to BIR investigators Gutierrez and the company he managed failed to disclose revenue from services amounting to P39.60 million.

BIR stated that "the summary list (of services) submitted by the respondents' clients disclosed revenue of P39,915,935.75 while revenue declared by the respondents per tax returns filed was P311,111.08" BIR said.

The Bureau of Internal Revenue also investigates GMA Network who told the BIR that the company paid R Gutz Production Corp., owned by Richard Gutierrez around P39.91 million. These resulted in BIR's assessment of an estimated deficiency in tax liabilities amounting to P38.57 million, inclusive of surcharges and interests.

Should Gutierrez be found guilty of tax violation, he could face up to four years of imprisonment and be fined up to P100,000 according to Section 254 of the Tax Code.

Aside from Richard Gutierrez himself, his company R Gutz Production Corp., could also fined up to P100,000. Richard Gutierrez became the 21st taxpayer charged under the Run After Tax Evaders (RATE) Program under the Duterte administration. This program aims to run after high-profile tax evaders.

Tesla cloud account hacked to mine cryptocurrency
